Tex Tex Concrete provides commercial and residential concrete and demolition services, including but not limited to flatwork, slabs, parking lots, foundations, site preparation, and structural or selective demolition.
All services are performed in accordance with industry standards, project specifications, and agreed-upon contract documents.
2.1 Project Conditions & Client Responsibilities
The client is responsible for:
Providing accurate project information, plans, and specifications
Ensuring site access, utilities, and work areas are ready
Identifying property lines, easements, and underground utilities
Obtaining permits, approvals, and inspections unless otherwise agreed in writing
Tex Tex Concrete is not responsible for damages resulting from unknown site conditions, including but not limited to underground utilities, unstable soils, hidden structures, or inaccurate plans provided by others.
2.2 Site Conditions & Unforeseen Work
All pricing and scope are based on visible and known conditions at the time of proposal. Tex Tex Concrete reserves the right to:
Adjust pricing due to unforeseen conditions
Issue change orders for additional work required
Suspend work if conditions present safety risks
Unforeseen conditions may include, but are not limited to:
unsuitable soils, buried debris, rock, water intrusion, or structural inconsistencies.
2.3 Demolition Disclaimer
Demolition activities inherently involve risk. While Tex Tex Concrete takes all reasonable precautions:
We are not responsible for hidden or concealed conditions
Adjacent structures, finishes, or utilities may be affected despite controlled methods
Vibrations, dust, and noise are normal and unavoidable
Any hazardous materials (asbestos, lead, mold) are excluded unless explicitly agreed
2.4 Use & Load Limitations
Client agrees that:
Concrete must be used only for its intended purpose
Excessive loads, improper use, or misuse void any warranties
Early loading or traffic before proper curing is at the client’s risk
2.5 Delays & Force Majeure
Tex Tex Concrete is not responsible for delays caused by:
Weather conditions (rain, heat, cold, freeze)
Material shortages or supplier delays
Labor shortages or unforeseen site conditions
Acts of God or events beyond our control
Schedules are estimates and not guaranteed completion dates unless explicitly stated in writing.
2.6 Indemnification
Client agrees to indemnify and hold harmless Tex Tex Concrete from any claims, damages, or liabilities arising from:
Site conditions beyond our control
Inaccurate information provided by client or third parties
Improper use of completed work
Work performed outside agreed scope
2.7 Warranty Limitations
Any warranties provided are limited to workmanship only and do not cover:
Natural concrete behavior (cracking, shrinkage, color variation)
Damage caused by third parties
Environmental conditions or acts of nature
Improper maintenance or misuse
All warranties must be defined in writing within the project agreement.
2.8 Change Orders
Any work outside the original scope must be:
Documented in writing
Approved prior to execution
Subject to additional cost and schedule adjustments

Tex Tex Concrete shall not be liable for indirect, incidental, or consequential damages
Liability is limited to the value of the contracted work performed
